These Terms of Use ("Terms") govern your use of the Mixer mobile application ("Mixer" or the "App") provided by Mixer ("we", "our", or "us"). By using the App, you agree to these Terms.
1. Eligibility
You must be at least 13 years old to use Mixer. By creating an account, you represent that you meet this age requirement.
2. Your Account
You are responsible for maintaining the security of your account and for all activity that occurs under it. You must provide accurate information when creating your account. We reserve the right to suspend or terminate accounts that violate these Terms.
3. Your Content
You retain ownership of the content you create and share on Mixer. By sharing content, you grant us a limited license to display and distribute it through the App as intended by your sharing settings. You are responsible for ensuring you have the right to share any content you post, including music, images, and videos.
4. Acceptable Use
When using Mixer, you agree not to:
- Share content that is illegal, harmful, threatening, abusive, or harassing.
- Infringe on the intellectual property rights of others.
- Impersonate any person or entity.
- Attempt to gain unauthorized access to the App or its systems.
- Use the App for any commercial purpose without our permission.
- Upload malicious code or interfere with the App's operation.
5. Intellectual Property
The App, its design, features, and branding are owned by Mixer and protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the App without our written permission.
6. Third-Party Services
Mixer integrates with third-party services including Apple Sign-In, Google Sign-In, and Apple Music. Your use of these services is subject to their respective terms and conditions. We are not responsible for third-party services.
7. Account Deletion
You may delete your account at any time from within the App (My Account > Delete Account). Upon deletion, your personal data will be removed within 30 days. Publicly shared content may persist in cached form for a reasonable period.
8. Disclaimer of Warranties
The App is provided "as is" without warranties of any kind, whether express or implied. We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components.
9. Limitation of Liability
To the maximum extent permitted by law, Mixer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
10. Changes to These Terms
We may modify these Terms at any time. We will notify you of material changes through the App. Continued use of the App after changes constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by and construed in accordance with applicable law, without regard to conflict of law principles.
